Tresstle Terms of Sale

Our website is a platform to enable third parties (“hosts”) to host events with multiple stall holders (“participants”). Buyers (“customers”) may access the events and purchase from participants.

My Artisan Markets Ltd is a limited company registered with Companies House trading as Pedddle & Tresstle. Company number: 10170925.  Within this document we will refer to ourselves as Us/Our/We. Who these Terms apply to:

These Terms apply to hosts who are signing up with us to host and promote their events, and to participants who are selling their goods or services at hosts’ events. These Terms do not apply to customers who purchase goods or services from events.

Use of our services or our platform is governed by: 

By purchasing our services or otherwise using our platform to host or participate in an event, you confirm that you accept these Terms and the above documents, and that you agree to comply with them. If you do not agree, you must not purchase our services or otherwise use our platform. We recommend that you print a copy of these Terms for future reference.

If you are a customer:

If you are a customer purchasing goods or services from an event, these Terms do not apply to you. Please contact the stall holder who you purchased the goods or services from with any questions or queries regarding the goods or services you have purchased.

If you are unable to contact the stall holder who you purchased the goods or services from, you are welcome to contact us via email at [email protected] and we will help you to get in touch with the stall holder. 

Customers have the opportunity to contact hosts and participants— we would expect that people will use these contact forms appropriately and will treat those contacted courteously.

Transactional Terms & Conditions.

Tresstle only offers service to other businesses and not directly to consumers. On creating an account with us there are terms to abide by but not contractual period by which you must stay. See our Frequently asked questions for more guidance on how to use the site effectively.

Payment (for participants only)

In consideration of our provision of the platform and the services for you to participate in events, you will pay the fees as set out in this section. Any and all actions designed to avoid the payment of any fees described in these Terms are strictly prohibited.

All participant billing is through the Stripe payment gateway. We do not store any banking details and do not have access to them.

Payment due to a host for participation in an event is subject to that host’s specific terms & conditions. However, our platform fees will be deducted from the participant’s payment to the host, and these platform fees are non-refundable.

Our host packages are to provide additional services in addition to the basic market.

Payment (for hosts only)

All participant billing to you is through the Stripe payment gateway. We do not store any banking details and do not have access to them.

Participant payments for events are made directly to your Stripe account. Tresstle will automatically add platform fees to your event cost (which may vary depending on the participant), and deduct these fees from your received payment. You will be responsible for paying all of Stripe’s fees, including those related to Tresstle’s platform fees.

Cancelling your accounts

When an account is cancelled at your discretion all services and offers relating to the account will be terminated.  No refund or rebate will be offered in relation to unused services including prior payments for event participation.

Your right to cancel

You may cancel your account at any time.

If you are a host and have outstanding events, you must inform your participants and arrange repayment for any services paid in advance. We accept no responsibility for event hosts that do not fulfil their responsibilities.

Our right to terminate services

We reserve the right to cancel an account if we feel it has been mismanaged. 

For event hosts on Tresstle we expect to see quality events being offered, have a good rapport with participants and have an active marketing plan.

If we feel that your events are no longer suitable for our Site we (Tresstle) reserve the right to remove your ability to host after all events are fulfilled. 

We feel that our standards are paramount and you will be informed if we feel that your events are no longer suitable for Tresstle.

Content

Account Content

As an account holder, it is your responsibility to ensure that all information (including your name and contact details) on the site are correct and accurate. This information will be stored on the site.  

We do not store any personal information on site, except for your basic contact details.  

Any content that you upload to the website is shared willingly by you, it is in your best interests to keep it up to date and we ask that it is your own and that you’re not infringing or violating any third party’s rights by uploading it. By uploaded content to the website, you are confirming that you have the rights to use these images. By uploading content to Our site, you grant Us license to use it in marketing related to Tresstle and your business. In addition, you grant the host permission to also use it for promotion relating to the event (that you are included in) and for promotion of your business.

The storage of any information is in compliance with the GDPR, 2018, and any such party that works on the site have completed an NDA.

Services offered by Tresstle

Online events

We provide a platform to host or be a participant in an online event. All events are hosted and organised by a third party (in some instances our sister company will run events and these will be branded as Pedddle events).

We make no guarantee of sales being made during the event, nor do we take any cut of any sales made as a stallholder. We do have a platform fee which is taken from the participant’s initial payment.

As part of the event, you are required to share it on your social media platforms and use the branded images (if supplied). Collaborating effectively with the host/organiser will increase opportunities for success.

Any sales made with a stallholder is in accordance with their terms and conditions and not ours. We take no responsibility for disputes in the event of an issue. As the items have not been purchased through any payment gateway on our servers we hold no information of the customers.

Using our services

When using our platform, you must do so lawfully, fairly, and in a manner that complies with these Terms. Specifically:

  • you must ensure that you comply fully with all local, national, or international laws, and/or regulations;
  • you must not use our platform in any way, or for any purpose, that is unlawful or fraudulent;
  • you must not use our platform in any way, or for any purpose, that is intended to harm any person or persons in any way;
  • you must always provide accurate, honest information about yourself, your event, and any and all items that you are selling at an event.

When using our services, you must not post anything or sell anything that breaches our Acceptable Use Policy, which is set out in our Website Terms and Conditions https://tresstle.com/website-terms-and-conditions-https-tresstle-com/.

Participant’s responsibilities

The parties to any transaction taking place through any events hosted on our platform are you, the participant and the customer. In order to provide the most responsive services to customers, any customer complaints, issues, disputes or negative feedback will be directed to you in the first instance. 

When selling at an event on our platform, it is important that all descriptions of items are truthful and accurate, and that all visual representations are true representations of what you are selling (as far as is reasonably possible).

We do not pre-screen participants or any items that participants advertise or sell at events. As such, we are not in any way responsible for any items sold or for the descriptions of any items sold at an event.

It is your responsibility to collect and pay applicable taxes on any sales made through events hosted on our platform. Where any tax or additional charge forms a part of the price of any item you list for sale at an event, you must include the tax or additional charge in the price of the item. It is your sole responsibility to ensure that any taxes or statutory charges on your products are charged and collected correctly and accounted for appropriately.

It is your sole responsibility to ensure your delivery policy and returns policy meet any legal requirements pertaining to distance and online selling, and to take into account any legal or regulatory consumer rights the customer may be entitled to.

Our Liability to You

We may be responsible for any foreseeable loss or damage that you may suffer as a result of our breach of these Terms or as a result of our negligence.

Subject to the section above, to the fullest extent permissible by law, we will not be legally responsible to you for any loss of profit, loss of business, interruption to business, or for any loss of business opportunity.

Nothing in these Terms seeks to limit or exclude our legal responsibility for death or personal injury caused by our negligence (including that of our employees, agents, or sub-contractors), or for fraud or fraudulent misrepresentation.

Events Outside of Our Control (Force Majeure)

We will not be legally responsible for any failure or delay in performing our obligations to you where that failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to power failure, internet service provider failure, industrial action by third parties, civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism, acts of war, governmental action, pandemic, epidemic or other natural disaster, or any other event that is beyond our reasonable control.

If any event described under this clause 15 occurs that is likely to adversely affect our performance of any of our obligations to you:

  • we will inform you as soon as is reasonably possible;
  • our obligations under this Agreement will be suspended and any time limits that we may be bound by will be extended accordingly; and
  • we will inform you when the event outside of our control is over and provide details of any new dates, times, or availability of services as necessary.

Affiliations

From time to time We will have associations with third party companies. We take no responsibility for your interactions with these organisations.
